You may have a case. We'd be happy to review it with you. There are three aspects to every case- 1) fault, which is based on whether the store should have known and remedied this condition; 2) did it cause damage or injury which is clear and 3) what is the value of those damages and injuries and, for injuries to the person, the pain, suffering and inconvenience they cause you worth? Whenever you are injured as a result of another person’s negligence (carelessness), you may be entitled to compensation for (1) medical bills, (2) lost wages if you are unable to work, (3) pain and suffering, (4) any permanent injury or disfigurement, and (5) inconvenience and loss of enjoyment of life. Sadly, many people are injured in Walmart stores under similar circumstances. Unfortunately, people sometimes find that they have trouble getting assistance from the store after an accident. Did you file an insurance claim with Walmart? Sometimes, people find that Walmart is unresponsive to their claims, losing documents and failing to return phone calls. If that is the case, you will almost certainly need the assistance of an experienced personal injury attorney to help you. An initial consultation is free, and an attorney will be able to tell you what steps to take next. In the meantime, the most pressing priority is getting whatever medical care you need. From the information you have given me, it sounds like you have already taken care of the most important issue – visiting a doctor. Make sure to follow up with the doctor as necessary, for two reasons. First, and most importantly, follow up visits will ensure that you heal properly. Second, people (claims adjusters, attorneys, and even jurors) are often suspicious of those who claim to be injured but fail to follow the doctor’s treatment plan. Finally, please do not talk anyone from Walmart in person or over the phone about the accident without an attorney present. Big stores employ people that are trained to minimize the damages an injured party can recover and they may try to get you to admit fault in the accident. I have handled similar cases against Walmart before, and they are often unwilling to compensate people for their injuries without a legal battle. Good luck.  For more information on handling a claim against Wal-Mart, see Five Things to Know if You Are Injured at Wal-Mart.
