The driver had $100,000 in Personal Injury coverage. I have seen a neurologist and chiropractor. I have ongoing migraines, pain in my arms and legs, visual problems. I was working full-time up to the day of the accident. The neurologist recommended surgery; my attorney is saying I should 'lessen my demands' of the $100,000 policy, and that I have to have surgery to settle the case, and so I won't have permenant nerve damage. This accident was August 2017. The attorney is seldom available for questions, will not give me copies of any documents, and told me State Farm is offering $17,000 to settle the case. I really am uncomfortable with communications with them, feel they are not truthful with me, and there have been many puzzling delays. Should I consult another attorney? Do I have to settle for less than the amount of the policy? Thank you.
You can ALWAYS consult with another attorney, for no cost. If you are this uncomfortable, it sounds like you should reach out to another attorney who will have better communication and be more attentive to your case. That being said, no attorney can guarantee what offer the insurance company is going to make, and has no way to actually make them increase it, other than through diligently working your case up, and having credibility with the insurance company. They should, however, explain with you the plusses and minuses of settlement versus litigation, and should be in contact with your doctors for their opinions on it.
