QUESTION

May we sue our chiropractor for malpractice?

Asked on Dec 29th, 2014 on Head and Spinal Injuries - Florida
More details to this question:
Only chiropractor to see our daughter starting at age 10 for 2 years for the begginning of a mild case of scoliosis of the spine. In March 2014, at an appointment he noticed a rib hump on our daughter, took x-rays and said he could not help no more and we needed to go see a different chirpractor in Orlando for 2 weeks to straiten her spine. We took her to a orthapedic doctor at Cleveland Clinic. The doctor looked at her x-rays and immediately referred us to Miami Childrens Hospital (MCH). The doctors at MCH diagnosed her with a servere curvature of the spine of 65 degrees, her ribs were spreading and starting would soon effect her lungs. Therefore, she has spinal fusion surgery on July 30,2014. The surgion had to fuse T-1 to L -2 in her back. How did the first chripractor not see this condition developing? This mistake of not noticing did to cause her to have a life changing surgery at 12 years old and for her future? Therefore, we would like to be our daughters voice and ask.

Possibly, but it would take a clear determination that prior diagnosis would have effected a different result. The only way to have a realisitic idea would be to consult with an attorney immediately, and to obtain a clear medical opinion on whether malpractice occurred and if so if it would have changed the result.
