modified brostrom surgery failed

More details to this question:
I had a modified brostrom surgery on my left ankle in 2012 and it failed. The surgery was a success from what I was told and my ankle healed perfect. Now 2 years later I need a second more aggressive surgery with a donor tendon. Can I hold the surgeon financially responsible for the first surgery failing since I am unable to work because my ankle is so unstable?
