My brother passed in October 2013. He was in the hospital and the morning he was to be released he asperated and nobody knew how long he was down. So

when they found him he had lost a lot of oxygen to his brain and was then put on life support for a week then he passed. I was wanting to know if we had a case for negligence because nobody could tell us how long he was down before they found him.

I'm sorry to hear of your loss. Whether or not the hospital was negligent in failing to supervise your brother in large part is based on what condition he was admitted for. Without looking at the medical records and getting further information about the case, it is impossible for anyone to determine whether you have a claim.
