QUESTION

My mother fell and hurt herself

More details to this question:
She was walking on the sidewalk near the church on Dec 20, 2020 in olean, ny and she tripped over a raised section of cement and fell forward. Unable to respond quick enough with her hands full she fell face first. She had 2 black eyes, a bruised chin, and a bent and bruised nose. She refused to go get medical attention and I did not know about this till a week later. She seen her dr. on Jan. 26, 2021 because she was having constant headaches. Dr sent her for an mri and she was having mini strokes, she was admitted to the hospital for surgery and had a blockage removed from her artery in her neck. They think she may have had a piece of stuff seperate and go to her brain to cause the headaches. I am inquiring about if she has any legal options, I can not get her to talk to anyone. She is 79 yrs old and doesnt want to cause trouble.

Ms. Crooks, so sorry to hear what happened to your mother.  In New York, owners of real property have a legal duty to maintain their premises in a reasonably safe condition.  Additionally, according to the City of Orlean's Code, owners are required to maintain the sidewalk in front of their premises in good repair.   Your mother should speak with an experienced personal injury attorney to investigate this matter and protect her rights.  The owner of the sidwalk on which she fell may be responsible for her injury including, if you are able to prove so medically, her mini-strokes.  In the meantime, you should take photographs of the sidewalk in question so that you can prove what it looked like at the time of your mother's fall and to guard against the possibility that it might get repaired.
