At a t intersection my son had the stop. He did stop and proceeded to start his turn because there was no oncoming traffic. He was already into his turn when he was tboned. His suv was even lifted off 2 wheels from the impact. The speed limit is 45. The other driver had a passenger, and my son didn't. The other driver was in a hurry to get to homecoming. Was harassing my son for his name and insurance info and yelling. The cop have my son the citation for failure to yield to the right of way. The cop had an attitude towards my son due to our last name. The other kid only got a verbal warning. I have pictures of my son's jeep. And of the skid marks. The tow driver for my son stated from what he's seen in his experience the other driver was at fault. The police report is saying my son was 100 % at fault. I want the citation reversed, the other driver to pay for my son's jeep, tow cost,Dr bill, lost wages. He has a concussion.
You will need to hire a criminal defense/traffic lawyer to contest the citation or show up in court and fight it yourself. When you are making a right hand turn, you need to yield to incoming traffic. I'm not sure that your son is 100% at fault, but arguably the majority of the negligence seems to lie with him in my opinion.
