My neighbor attacked me 10/29/2020. He is 82 and I am 62. I have the incident on video. I filed a police report. I had several scratches, fat lip and bruising, as well as contusion in both shoulders. I received a call this week (8/2021) from DA that he was charged with battery. My out of pocket (ER) expenses (minimal co-pay) are being recovered. However, during this time both my shoulders were incapacitated and I was in severe pain, and I couldn't raise my arms up without excruciating pain until recently. I had no treatment other than pain medication from my doctor. This was the beginning of covid and no one was answering any calls during this time. My question is: can I sue him for pain/suffering as well as punitive damages? He jumped out from the other side of a bush and sucker punched me.
