No fault accidents

More details to this question:
I was a passenger in a car accident. I previously had sinus surgery and on the impact of the accident it triggered something inside my sinuses that the doctors can't seem to find the cause of but I'm still seeing the Ear Nose and throat doctors to get to the bottom of what I'm going through. I'm just about 100% sure this started on the impact of the accident but didn't really focus on it because of my previous experience with my sinuses but remember clearly that, that's when it started and I'm still going through it?

Mr. Reyes, sorry to hear what you've been going through.  In New York, you can only bring a personal injury lawsuit arising out of a motor vehicle accident if you've suffered a "serious injury" within the meaning of the law.  The law has various definitions of what constitutes a serious injury.  Sinus issues, without more, might not qualify.  Even assuming your sinus issues constitute a "serious injury", you'd still need to prove through competent medical evidence that they were caused by the motor vehicle accident.
