PTSD triggered after car accident. Who is liable?

More details to this question:
Accident was days before her 18th birthday she was not cited as the officer felt that speeding and rear ending my vehicle and injuring my child and myself while she was texting was not a crime that warranted a citation. I was injured with nerve and spine damage my PTSD was triggered and has effected every aspect of my life. its going on two years of treatment and its just gotten worse. Who is liable for these life changing events.

If you can show through your medical providers these conditions were caused by the accident, the person who hit you is liable. Her insurance, if she had any, or any insurance covering her vehicle should take responsibility. If there is not enough insurance, and you have underinsured motorist, you should also make a claim against your insurance company. The statute of limitations on a case like this is three years from the date of the accident. If you do not settle your claim or file a lawsuit within this time frame you will forever be barred from pursuing an action against the at fault party. You need an experienced attorney ASAP.  Call me.  Whether or not the driver that hurt you and your child was cited is neither here nor there.  You need direction for treatment and representation in order to both heal properly and then obtain a fair settlement once treatment is concluded.  Not to mention dealing with insurers now and finding the right people like chiro, masseuse, massage etc.  Look at my web page and AVVO.com for reviews.  I have 21 five star revoews and provide the best representation available.  Without an attorney, the insurance co's offer like 500 to 1,000.  I will get you 20 times that or more depending on how egregious the injuries and it sounds like liability is established.     Thanks   Jason 206-304-0660
