QUESTION

Qustionable car engine repair after accident.

Asked on Sep 25th, 2014 on Automobile Accidents - Maryland
More details to this question:
My daugher recently had a car accident and had her car engine repaired. The shop had to remove the entire engine to put a new radiator in. Two months after the repair, the engine siezed and failed. The repair shop is saying this is not their problem as it occurred two months after the repair. The insurance company is sending an adjustor to the repair shop to look at the damage. What is my daughter's next step if the auto shop does not assume any accoutablilty for the repair? In talking to them on the phone, they are saying it is not their fault. The car is a Toyota Rav with 80K miles on it. It has been very well maintained (I owned it before gifting it to my daughter).

You need to be able to prove that the engine seizing and failing was the fault of the car engine repair shop.  I suggest that you have a different car engine repair shop give you an opinion.  Perhaps the insurance company adjuster will be able to make that determination for you.  You can always file a lawsuit against the car engine repair shop but in court you will need to prove that the engine seizing and failing was the fault of the car engine repair shop.  Good luck with this matter.
