Rental Car Proof of Insurance

More details to this question:
My daughter went to a MD Rental Car company and asked to rent a car using cash. She does not have car insurance. The Rental Agent who is no longer at that Location, Leased my daughter a rental car and allowed her to rent without proof of having credit card insurance or private insurance. This put my daughter 21/ at great risk. Looking on the webiste for that company-, "... a number of _ locations accept cash as a valid form of payment though cash customers are required to present additional documentation such as two current utility bills, a recent pay stub, proof of insurance and personal references. My daughter was rented a high power sports car and ran into a guard rail when it was raining. (No insurance) What should be the next step. /

Under Maryland law, the rental car company has to have its own insurance on the rental vehicle.  If the accident was your daughter's fault, she will likely have to reimburse the rental car company for the damages caused to the rental vehicle and the loss of use of the rental vehicle to the rental car company.  If you daughter was covered under anyone the auto insurance policy of anyone else on the date of the accident, make sure the collision is reported to that insurance company.  As to whether the rental car company was in error for renting the car to your daughter, you should consult with an attorney familiar with dealing with rental car companies.  Good luck with this matter.
