On Sept. 11th. I was riding my bicycle on the sidewalk along Countryway Blvd. near Boysenberry Drive in Tampa /Westchase, when I hit a section of broken sidewalk not evident from my direction of approach. However, the cracked sidewalk had been marked with paint visible mainly from the opposite direction. I learned this later; after my front wheel struck the broken sidewalk throwing me from the bike and breaking my collarbone. Helpful passersby called paramedics; I went to the Tampa Community Hospital emergency room, where the clavicle fracture was confirmed by x-rays. On September 13th I consulted an orthopedic specialist who recommends surgery to fix my collarbone. I have health insurance that should cover a portion—though not all--of the medical costs. I believe the sidewalk was substantially damaged; that the damage was previously known, and should have been closed pending repairs. Please advise whether I might have a case likely to result in a reimbursement settlement.
Im sorry to hear about this incident. The first thing you should do is take many pictures from different angles of the cracked sidewalk. Do this immediately. Then contact counsel here in florida. Depending on the pictures, you may have a good case.
