QUESTION

Should daughter be put on new car title?

Asked on Jun 22nd, 2013 on Automobile Accidents - North Carolina
More details to this question:
I'm buying a new car. There is a $500 college rebate available but to claim it, I would have to have my daughter's name on the car title. She is 22 and will most likely use the car the most part to get to school and her job. Is there a liability issue if I add her name to the title and registration or should I forego the rebate and just leave the title in my name only?

Are you suggesting that you would commit fraud to get the $500 for the car? The truth shall set you free.

Since she will be driving the vehicle, she will have liability as the driver and you will as at least a part owner of the vehicle [up to $15,000]. If she is not put on title then there might be a problem with her having any insurance coverage.

There would be no liability unless she is an incompetent driver.

You have the liability issue if she will be driving the car, as well as for anyone else driving the car. The liability goes with the use of the car, so it is irrelevant whether or not she is on title.

If your daughter is going to be the sole driver, by all means add her name to the title to qualify for the rebate. If your name is on the title, as well, bear in mind that you have responsibility as an owner of the car if she causes an accident.

You make the call. The owner and the operator of a vehicle are liable for its operation.
