I cosigned a car with my ex back in 2015, two months later we went our separate ways. I advised him several times to remove me from the loan, he never did. On April 2017 he got into a accident where he was at fault. Now the attorneys are asking me to sign affidavit, I don't have assets only my insurance policy which they are trying to get a hold of. I'm not sure what I can do. Do I need to fill out forms? How will it affect me?
If there was insurance coverage, then they will hire a lawyer to represent you (and your ex, as both owners of car will be sued if they havent already), and cover any damages owed up to the policy limits. Put the insurance company for the vehicle on notice immediately if you havent already. You may have to fill out the affidavit eventually, but the lawyers are looking for insurance coverage, not to try and collect from someone with no assets. Good luck.
