QUESTION

Should I hire an attorney?

Asked on Apr 08th, 2013 on Personal Injury - Michigan
More details to this question:
My car was t-boned yesterday by a driver who runs a red light. I was and I still am in a lot of pain but when I got to the hospital, they just gave me pain medications. I insisted they give me an x-ray. There were no broken bones so they discharged me. I believe I have a concussion in my neck and my back is pain.

what medical school did you attend? If you are still hurting, go to your regular doctor. An ER only deals with life-threatening injuries, and once they stabilize you, they send you to your regular doctor. Pain is NOT the only way to value a case. Pain will usually abate. Your doctor needs to check you out completely, and if he/she thinks that you need other specialties, to refer you to them.

Whether to retain counsel is up to you. Most Michigan attorneys take car crash cases on a contingent fee basis, which means you only pay a fee if there is a recovery (although you do remain legally liable to pay all the costs of the claim). However, you do need to prove you suffered a serious impairment of a body function and/or permanent, serious disfigurement to qualify for damages in a case against an at fault owner/driver of a motor vehicle. Unless your injuries continue and you receive further medical care/testing that supports having a "threshold" injury, you likely don't have enough proofs to support such a case.

Sorry to header about your accident. You should hire an attorney immediately. You also need to follow up with your primary health care physician to make sure your injuries are not more serious.

Yes, you should see a lawyer. First consultations are almost always free, and you will almost always do better with a lawyer than without one.

If you heal up quickly, you may not need an attorney. However, it certainly makes sense to talk to an experienced car accident lawyer for a free consultation. At least you will know what your rights are and what you may be entitled to.

Let your insurance company handle the matter. If your injuries get worth, retain an attorney so that you can sue for pain and suffering.

In my opinion, it is premature for you to get a lawyer at this time. I would go to your Dr. and see what is wrong and how bad it is first. If it looks like there is something wrong that is going to require a lot of treatment over time, you may want to consider getting an experienced accident lawyer.

First, make an appointment for follow evaluation and care if you are still in pain. Nothing is more important than your health. The, yes you should absolutely hire an attorney. If you think the hospital treated you badly wait until you try to deal with the insurance company.

You should follow up with a doctor right away. Emergency rooms are no substitute for a thorough medical exam by your primary care physician or chiropractor. You should contact a personal injury attorney in your area right away to preserve your rights, and in the interim, do not speak with the insurance adjuster for the at-fault party.

Yes, but you should first get the best medical treatment you can get, particularly if you think you suffered a concussion (that would be in your head, not in your neck) and you still have pain. You should ask your primary care doctor for a referral to a physiatrist (a doctor who specializes in physical medicine and rehabilitation).
