Slip and Fall and/or Workers Compensation Case?

Approximately 10pm on Saturday, 5/30/26, my wife (Yonin Xiomara Huden) was leaving work and walking to her car with a fellow associate. As she walked down the gravel driveway, she slipped with her left foot, resulting in a direct landing on her right kneecap. Her and her co-worker reported the injury to the manager(s) on duty and her co-worker drove her to the nearest emergency room, where she was treated. After her x-ray was read, it was determined that she has a Closed Displaced Fracture of her right patella. Surgery was the initial recommendation due to the severity of the fracture. She is a banquet event server at 7 different hotels and will likely be out of work for at least 3 months.

If this happened on her employers property and it occurred during her work hours, it would most likely be covered by Worker's Compensation. If the property that she injured herself on was owned or managed by a third-party and through the negligence of that third party then she would have a third-party claim. This would be in addition to the workers comp Claim. Discuss this with an attorney in your jurisdiction for specific advice.
