My son was in crosswalk on his bike when he was struck by a car, he is ok thank the Lord, the lady that hit him said he was not paying att, there were 4 lanes 2 were turn lanes into a school and the other was into our road he was passed the double yellow line when she hit him when I arrived he was allready on way to the hospital I took pics of her car & rush to hosp, when i picked up report it states it was his fault she said he was not paying attention & the report said there was 2 lanes and he ran into the side of her car ,and it happened right at the start of crosswalk the 2 friends that were with my son say this is not true he had been hit past the double yellow line called the police station 6 times over the next week to talk to the police officer after asking 6th time thay sent email to supervisors he finly called and was very hostile to me he said he would not change the report what are my sons rights ???
Well to start you wont get far with the 'ol " I talked to some witness who said...so change the report" issue. You will either need to get the witnesses to contact the investigating officer or provide notoarized statements etc. Same thing for the alleged admisson by the other driver, its tainted by your relationship to son, unless SHE contacts cops to correct statement. Bigger issue is, to what end is this concern? If your son was not hurt, and he was not charged, I am not sure why this is a big issue. If you are looking at making an injury claim of sort, if your son is not OK but was hurt, I would focus more on the issue of whether the car hit your son or he ran into it. This could e more problematic.
