PI case . 4 surgeries 2 spinal fusion $ 400,000.00 an ongoing therapy 2 yrs this April. 2 Mediations cancelked by Defense. 1 trial date cancelled too . The upcoming trial set for March 3 will be cancelled too , as my attys advised me ystrdy . The USA has put me on SSI & Foid stamps ! My life is poverty , i havr lost everything. Minus my humor . They informed me ystrdy as well this could go on for another year and if we win they will appeal and that could be another year an a half /????? Iam so stresssed i could jump my balcony . I need my day in court . My Atty tells me they wont Offer a Nickle at Mediation ! Okay iam good with that . So if that beknownst tell the courts , right ?
I am a long time practicing personal injury attorney and am not sure what you are seeking advice on. The short answer is yes, you can take the case to trial, but it may not be in your lawyers control; so you need to understand why the case is being continued. You have not given me any understanding of the issues, which I am sure are complex, to give you even general advice or guidance.
Do you know why the insurance company is not making you any offer? Do you know why the case keeps getting continued? You clearly have serious injuries, but your lawyer is the person who can best advise you what is going on. For all I know the case is getting continued because you are preparing for more surgery, or your lawyer is hesitant to try to case because you have a long standing pre-accident history of similar medical problems and/or very difficult liability. It could be that the other side had a conflict with experts they need at trial.
Significant injury cases are very complex, with multiple issues to be considered. No lawyer on this listserve will be in a position to question what your lawyer is doing, without a complete understanding of your case.
