Traffic accident

My mom and I were in a car accident in 2012. No one got seriously hurt at the time, now the lady driving the car that hit us,who also bragging about getting a new car now, is suing us. My question is were we even at fault or is it our fault? We were at a cross street going straight and there were a ton of cars. It was time for school to be let out and there were two elementary schools in the area. All the cars had made it like a four way stop. So it was our turn to go but we couldn't see if any cars were coming and a truck had also gone so we figured it was safe. We pulled out and i saw it coming. She was coming at us really fast. Probably 45 in a 25. She was on her phone also, but who cares I had a goose egg on my head and my moms back was soar because of her arthritis. The lady was perfectly fine. We had been hit hard and her bags went off ours didn't.
