I tripped on an uneven paver at a local business 11/7, ended up in the hospital for 3 days with a dislocation and spiral fracture of the right humerus. Off work and medical bills are rising at a rapid pace, can I still file against the business>
Where was the pavement? How far away from the curb? If it wasn't on the business's property you will most likley have to sue the city. It sounds like u may have a very good case...A key issue is who owned controlled and maintained the pavement. If the private company did, the case would be far far stronger as governments have far greater defenses and much shorter time limits to seek redress to torts that occur on their premises...Have u established who owned the pavement which caused you to trip?
