VA law diminished value claim

More details to this question:
My car was rear ended. Their insurance company says va state law says to take a average market value minus what the after accident value is now (around $8,000 diff) and then add back in the amount they had to spend for repairs ($6,000 and i had to fight hard for new parts instead of repairing old) and they get a $1950 dimished value for my new audi sports car that now has bad car fax. Local car dealer says they cant add back in the repair costs! Is this true?
