Asked on Dec 28th, 2013 on Personal Injury - Texas
More details to this question:
there was a large hole in my work area (8ft x 12ft) I reported this and over several months it was not fixed. I was instructed to cover it up with a metal plate that was not large enough to cover the whole thing. I slipped in hole trapping my foot between hole and plate. was made to wait 7 hours before getting medical attention. in er company rep told doctors not to prescribe me meds or diagnose my injury as severe. when I could not come to work next day due to injury I was made to take apersonal vacation day. the hole has still not been fixed. as of now they are not following doctors restrictions on me. they are breaking osha rules in where they are putting me. they have not not done anything to make up for my lost wages

If the company has real workers' compensation insurance, it will be protected from lawsuit in most instances but you will be able to get workers' comp benefits along the way.  If you are not getting benefits yet, then we need to figure out why and pursue what you are owed. If the company does not have workers' compensation insurance, then you can actually sue your company for its negligence in the cause of your injuries.  The difference is that in this type of case you don't get any monetary benefit until after the case settles or goes to trial.

It depends on if your employer has work men's compensation insurance, or are non subscribers. I am glad to discuss this situation with you and explain how I can help.
