I am enlisted in the US Army and am currently deployed to Afghanistan. On Tuesday my wife was arrested for theft by shoplifting. Her sister was the one stealing but after they searched them both, they found nothing on my wife, but on her sister, they did. The manager accused my wife of helping her steal when my wife told them she had nothing to do with it and to let her see the cameras where they said she was helping. They refused and the officer arrested her. She has never been arrested before. This cause a huge impact on her record. Racism played a role on part of the staff. My wife ended up being arrested and I bailed her out. I hired an attorney to get that charge expunged. I am looking for further action on part of the staff for false arrest on their behalf. My wife cooperated with them and let them search her stuff. They chose to still prosecute her and make the assumption that she was helping her sister. Thank you for your time.
Normally stores like Walmart have a ton of surveillance. They probably had evidence they thought could prove she was helping. I would need to know more about the circumstances- did they ride to the store together? were they walking around together? etc before I could give you a better answer. False arrest and malicious prosecution actions can be very difficult. What county in GA did this happen in?
