You have the right to sue the McDonald's employee for punching you for your injuries and damages. You also likely have a claim against McDonald's, either the company itself or the franchise owner. McDonald's is generally responsible for the actions of its employees. This is called "vicarious liability." McDonald's may also be liable on its own as well. This depends on information not contained within your question, including, but not limited to: whether it knew or should have known that they the employee was going to assault you; whether it negligently hired the person who hired you if they knew or should have knew he or she was likely to assault customers; whether it could have done more to protect you. In addition, the City or County Attorney may pursue criminal charges against the McDonald's employee who punched you. You really do not have any control about any criminal charges. You may want to talk to a personal injury attorney. Most offer a free initial consultation so it will not cost you anything to learn more about your rights and options.
