More details to this question:
My car was struck by a vehicle while parked. We saw it happen and traded info with driver (she admitted guilt). I have a copy of her license and insurance. No police report. She won't return any phone calls from us or her insurance company. It's been 3 months. Insurance won't payout until they talk to her, but she refuses to return calls. Do I sue her in small claims? What are my options?

Best bet is to use your collision coverage and pay the deductible. Otherwise only remedy is a lawsuit and those are typically not productive financially.
