QUESTION

What can I do?

Asked on Jan 04th, 2024 on Personal Injury - Florida
More details to this question:
My daughter is a victim of bullying. On 12/11/23 she was attacked by 3 boys, causing her bruises on both eyes. She was outside with no adult supervision due to benefits students have when showing "good behavior". The school nurse did not file a report and told my daughter that the story was too much information, to shut up and not tell her anything else. The school did not call me to notify me that my daughter was beat up. We spoke to the school assistant principal and he had no idea of what happened. My daughter continued to be in the same classroom as these kids. We went to the school multiple times to ask to be changed and they refused. After insisting some more, they eventually changed her. The school counselor blamed my daughter for getting hit. I tried changing her of school but the scholarship is asking for the report that was never filed.

If the school was on actual or constructive notice that your daughter was being bullied by these students and didn't separate the bullies from your daughter, then she may have a case. You didn't specify the extent of her injuries. This is important because the value of the case would not only depend on liability but also on her damages, past and future.
