What can I do if my child was attacked?

More details to this question:
Since late 2011 when we bought our home the girl that lives across the street from us has been threatening my daughter and several students at their school. She wrote a note telling her teacher that the voice in her head keeps telling her to kill the class and kill herself. I am not sure why this kid was allowed to be at around other children. Yesterday while my daughter was walking home from the bus stop the girl across the street attacked her from behind, she pinned my daughter to the ground so that left her completely defenseless and was slamming her head on the ground, screaming at her "I hate you". My daughter has complaining of a sore neck, she has a busted lip and her face is now swollen. There were several witnesses that saw what happened, there have also been a number of students going into the office to report the many threats that this girl has made towards them. We filed a report with the constable that came out to talk to my daughter and I talked to the school about the attack. I want to file charges and see if there's any way that I can legally request that she is put out of the school; it is very evident that she is a threat to the other students and possibly herself.

If your daughter was the victim of an unprovoked attack by a neighbor, you need to contact the prosecutor's office and see why they have not charged the girl with criminal assault. If you can document the prior threats made to other students and that they in fact complained to the school, you may want to meet with school authorities and find out why they have done nothing to put a stop to the assaultive behavior. If the latest assault occurred off of school grounds, you can expect the school to say they have no authority over things that happen off the school campus.

Send a letter to the principal of the school outlining all the facts and your fears. Keep a copy of the letter.
