I was at work in a Ford Ranger pickup driving 30-35 miles per hour and a 15 year old threw a gallon of water from the 25th floor balcony of where he lived. The roof caved in and the windshield was crushed. I was full of glass all over, as that was happening the force threw my forward but I went against the force and turned to the left to avoid the glass getting on my face. At first I guess from the adrenaline I did not feel pain in my back but I went the day after to the hospital because I had glass in my foot. Six days later on 08/26/2009 I started therapy per my attorney but I did not get to finish it because my supervisor gave me a hard time about coming in to work about 30 minutes late after I advised him that I was getting therapy for my back that was in pain from the accident. I was never on worker's compensation for my back only that one time I went to the ER for the glass in my foot. I was afraid of losing my job so I stop therapy and fast forward to today I resigned from my job 10/01/2013 because the pain was too much as my job required me to walk for the 8 hour shift. Now I am unemployed and still in a lot of pain. Is there something I can do about my situation?
Workers comp is one remedy which you appeared to have explored. You should follow up with your attorney. Depending on the circumstances, there may have been a negligence claim against others, including the parents of the child who threw the water from the balcony, to recover compensatory damages. The problem for you would appear to be statute of limitations, since you suggest the incident occurred on 8/20/2009 (more than 5 years ago).
