What can we do if my daughter who is working on a restaurant was thrown hot chili fries by a customer burning her face and neck?

My minor age daughter had HOT chili fries thrown in her face by a customer while she was at work at a fast food restaurant, burning her face and neck. I filed charges at the local police station but have not heard anything and cannot get a straight answer from them. I want to sue them for derelict of duty and the customer for what she did to my daughter!!!

It is an assault, criminal charge and they can also be sued; Issue would be, are they collectible? Also look to the insurance of the employer for possible civil liability;
