More details to this question:
Driver ran red light in presence of police officer annd she hit my car and itโ€™s on his dashcam. Her insurance has total lossed my car and trying to make arrangements to pick it up and take it to a salvage yard but no one has looked at it. Also took my 5 yr old grandson to ER for headaches the following day. Insurance semt me a check for 1750 and 2500 to my daughter but we have no deposited them. They have said nothing about offering to pay to get my car fixed. I was without transportation since the accident. The said the check would enable me to get a rental car. My cell phone was also damaged when it fell from the holder. I need help or guidance please or a reference to someone who can help me.

In North Carolina, every driver must carry at least $50,000 in liability coverage per person and $100,000 per accident. That means if the other driver was at fault, the total available recovery for you and your grandson is $100,000. I would not deposit any checks the insurance company sent until a lawyer reviews the case. You should hire an attorney in your state on a contingencyโ€‘fee basis, which means you pay nothing unless you win. If you need help finding a lawyer who will take the case on contingency, feel free to reach out to one of us on this platform and we’ll help you find one at no cost.

I'm not sure of the date of your accident, but I would recommend that you take a consultation with personal injury lawyer licensed in state as soon as possible. If the accident is on dashcam, and the at fault drivers insurance carrier has deemed your car a total loss, I would hope they would pay for your property damage very shortly. If the insurance carrier needs more time, it is very likely that they would approve a rental car. An accident lawyer may be able to assist you with these issues.  My greater concern is the personal injury side of the claim. I'm not sure how significant the injuries are, and if there is follow up medical care needed. However, I would strongly advise you to not deposit those checks until you have reviewed this matter with an experienced injury lawyer. You do not want to settle the claim until you know all of your rights. Disclaimer: This response is for general informational purposes only and does not create an attorney-client relationship.
