On the day before Thanksgiving, I took my 2012 Ford Mustang to Aamco Transmission Repair of Dallas for a problem that I was having with my transmission. They informed me that they would have to keep it for an undetermined amount of time to be repaired. On Monday, I received a phone call from their general manager stating that my car had been stolen sometime during the weekend. When spoke with the police officer that came to the shop, it was revealed that during the weekend, my car was left outside of the shop, unlocked with the keys in the ignition. I would just like to know if I have a case against the shop and what they are liable for as far as replacing my vehicle. And also, what type of lawyer would I need to get in touch with. Thanks!!!!
I wrote an answer earlier but I don't know if it was sent. The answer is that you are entitled to damages in the amount of the value of the car. Replacement is a possibility but tht is somewhat difficult as you may not get a vehicle that is in the same condition as the old one. Aamco should have insurance. Make a claim with their carrier or an attorney can help if you run into difficulties. This seems a very straight forward situation where there should be little argument over liability, the shop was negligent and you should not be penelized for their negligence. If suit is necessary and the value is under $10,000 you can file in the justice court and an attorny is not required.
