I got into an accident with no insurance. The other party's car was not damaged but mine was total. The driver drove her vehicle away from the scene. My car had to be towed away. The ambulance came to the scene to treat me and not the other driver. Matter of fact when the abulance came to the scene the other driver drove off already.I have an eye witness who is willing to testify that her car was not damaged and to testify to the whole incident. The other party's lawyer is trying to file a lawsuit against her (other party's) insurance company for damages to the vechile and medical bills. They are trying to go to court without my presence. What can i do not to have them get a judgement against me. Can i counter sue in this situation?
