What is my injury claim worth?

More details to this question:
I was recently in accident in which the other driver was at fault. My vehicle was totaled and I have had pain in my ribs and chest for over three weeks. I did go to the emergency room and have x-rays. The other driver's company only wants to give me $500. Is this all I can get?

It's negotiable, but it sounds like the insurance company is low balling you. There is no set value for pain and suffering. Presuming you are healed up and don't need any further treatment, your options are to negotiate or sue. If you are not healed up, you need to wait until you are and seriously consider talking to an experienced personal injury lawyer.

In Michigan you must have a serious impairment of a body function in order to have a successful 3rd party pain and suffering claim. Proving this depends on the medical testing and testimony. It also depends on the effect on your ability to live your normal life. Michigan does not allow minor injury auto negligence cases to be successful.

Allstate starts at 500. They may go to 600 or 10 or 12 to settle a case Problem is you were not hurt bad and you don't have much in the way of medical bills, so you wont get much. Take what you can get and get on with your life.

Every case is different and every injury is different. If you are still suffering pain in your ribs, you really would not want to settle at this point. There are a number of factors in evaluating the case including the duration of the injury, the type of injury, aspects of liability, whether there are lost wages, the extent of medical care and expenses and numerous other factors. You really should consider hiring an attorney who is experienced in evaluating these factors.
