what kind of case do I have?

More details to this question:
I was a passenger on a motorcycle. We was rear ended about 55mph from another motorcyclist. I recieved a small concussion, and bad abrasions.I received abrasions all down left side. The person that hit us, was drunk, no license, and speeding. (35mph) zone. I heard the cops whisper to him I could send you to jail, but Ill give you a break. Even If I cant prove they said that. Shouldnt he have to Jail anyways. Isnt That insubordination, attempted man slaughter. Police are suppse to protect and serve. I dont know where the guy went after the scene, but he could have jumped in another vehicle and risked somebody elses life. Right?
