My husband slipped and fell in our hotel room at Aruba Surf Club. The dishwasher leaked and the water accumulated under the adjoining door formed a puddle and my husband upon entering our room that evening slipped and fell. We have a statement from Guests from that room that they reported the issue a day earlier but it wasn't fixed. We have an Incident report, doctors records, PT records, pictures etc. We have been in touch with AIG their Insurance company and have been corresponding for over a year and a half. They made one offer which was a joke. The Adjuster takes forever to get back to me. I have sent her all necessary information and she continues to ask for more. They were 100% at fault. This incident would have never happened if they had fixed the dishwasher when the Guests reported it. Please help.
Sorry to hear about what happened to your husband. As operator of the hotel, Marriott was under a duty to maintain the premises in a reasonably safe condition and to repair any dangerous conditions thereon of which it had notice, in your case the dishwasher from the adjacent room. That said, Marriott is under no obligation to pay you for your husband's pain and suffering and economic loss. It is only obligated to pay a judgment entered against it. And the only way to obtain a judgment against Marriott is by filing an actual lawsuit. Unfortunately, even though Marriott is a domestic corporation, any such lawsuit would likely need to be filed in Aruba.
