What recourse do I have regarding a plastic surgery fiasco?

I went to a plastic surgeon explaining ( 77 at the time.) I do not want to look 20. I want to look rested. I stated I wanted my cheeks back and he said he would fill it with my fat. He assured me it would be great. I asked that all tell tale marks would be inside hairline. Aside from the cheeks, I asked that the area around the mouth be smoother and hoped I would not look as tired. Instead without telling me, repairing me or even suggesting the possibility, he repositioned my ears which is another problem now, including the fact, I can never wear my hair up because of obvious scarring. My cheeks are totally deflated and a previous operation to repair the clavicle is now back to square one, probably because of the ear situation. The repair was done approximately 4 months before the second surgery and I am experiencing serious leg pains from the areas he harvested the fat in. He fluffed me off with that's the breaks. It was 1 year ago in January. It is extremely traumatic. It was a gift and my friend died April 7th and I am no longer in a position to redo the mishap. Do I have a case? Thanking you in advance.

In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. A bad result is not enough, and if it is a "judgment call" by the doctor, there is no malpractice, even if the doctor made the wrong call. You will need to get copies of ALL of your medical records and have a surgeon review them; if he/she is willing to testify that your previous doctor(s) failed to conform to accepted practice, then you have a case.
