QUESTION

What should I ask for in a settlement?

Asked on Oct 02nd, 2013 on Personal Injury - West Virginia
More details to this question:
I was in a slip and fall accident at an eye clinic, my eyes was dilated at the time. I attempted to sit on a stool. The stool slipped from under me. Over I went to my right side knocking a hole in the wall. My shoulder hit a beam in the wall. I have a partial torn tendon in my right shoulder, severe aggravation of degenerative disc disease in my neck and severe cervical strain in my neck.

Why don't you hire a lawyer and let him/her worry about it. I can guarantee that if you try to do it yourself, you are going to screw it up.

You fell off a stool. Why is that someone else's fault? You have to be totally free of fault in NC before you can expect to win a slip and fall case.

The first thing you are overlooking is whether there is any liability on the clinic's behalf. It will take a medical expert's opinion on that. Presuming there is liability, you need to understand cases vary in value from case to case and place to place. An experienced personal injury lawyer that does malpractice cases in your area is in the best position to advise you on that.

This forum is really designed for general questions and not fact specific inquiries about case values. There are way too many variables involved for any type of accurate estimate based on a paragraph submission. Lawyers review medical records, bills, life expectancy, other similar cases, the facts of the occurrence, the permanency involved, disability, medication records related to the occurrence, statements of witnesses and/or parties, whether there were tickets issued and admissions made in the traffic case, the insurance company involved in evaluating a claim's value.

Assessment of damages in a personal injury case requires detailed analysis of liability, the injuries, and the effect of those injuries upon the individual. This analysis includes application of legal principles, evidentiary factors, medical documentation, out of pocket expenses, calculation of future losses and experience in your jurisdiction as to likely range of prospective jury awards. A "cookie-cutter" approach, a standard answer or a formula would be a disservice to someone such as yourself, who needs the help of an experienced personal injury lawyer. To answer the question properly, one would need extensive examination of all the evidence, particularly the medical records. Many people use this site to ask what their case is worth. Our answers are always: Get in touch with a personal injury lawyer in your area. That is the best way to get the best result in your case.

So sorry to hear of your serious injury. Here are some of the things you can ask for in a personal injury settlement: Accident victims can be compensated for economic damages: actual dollar losses such as medical bills, lost wages, and lost future income earning ability. Pain, suffering, humiliation, loss of enjoyment of life, are also some of the non-economic losses for which a person may receive compensation.
