Assessment of an appropriate settlement requires detailed analysis of liability and damages, including application of legal principles, evidentiary factors, medical documentation, out of pocket expenses, calculation of future losses and experience in your jurisdiction as to likely range of prospective jury awards. To answer the question properly, one would need extensive examination of all the evidence, particularly the medical records. Many people use this site to ask what their case is worth. Our answers are always: Get in touch with a personal injury lawyer in your area. That is the best way to get the best settlement in your case. Important, you mention that you have been fighting for three years. In NY and in many other states, the statute of limitations is three years and if you have not filed suit by then, it will be too late to do anything. You have been engaged in this struggle for three years with no lawyer? Hasn't worked out very well for you, has it? You are asking on the 'net what your financial recovery should be (meaning that you don't know) and you don't even know that to answer the question a lawyer would need an extensive interview, hundreds of pages of records and hours of analysis and research to arrive at a legitimate evaluation.
