What should I do after a car accident?

More details to this question:
My fatherโ€™s car was hit by someone. He tried to escape but I chased him and caught up with him. We both have back and neck pains. What can I do about this?

Assuming you have insurance information and at a bare minimum contact information for this person, and assuming the accident occurred within the applicable statute of limitations (2 years in Indiana), you should pursue a claim with his insurance company. I suggest you consult with a local personal injury attorney to determine if your claim is worth pursuing.

There are several things that you need to do including seeking medical treatment to understand the type of injuries that you have. Plus, upon evaluation, a doctor may determine if you will need some continued treatment to return you to the medical status you were just prior to the accident. There are also some other steps that you will need to take with the insurance companies. 1) Report it to the police; 2) report it to your own insurance company; 3) seek medical care if your having neck & back pains. There is a new specialty among doctors now called physiatrists who specialize in non-operable musculoskeletal injuries, and I might suggest that would be a good route to go.

You make sure to get medical care, otherwise the insurance carrier will ignore your complaints of pain. Get you a personal injury lawyer. Show up in traffic court and hope the bad guy gets convicted of hit and run. The insurance carrier would normally be expected to pay a claim like this (unless the car was stolen).

First, file a report with the police if you have not already done so. Then, file a no-fault claim with your insurance company. It doesn't matter that it was the other driver's fault; that's why they call it "no-fault". Notify your insurance company, get a claim number and a benefits application, fill it out right away and send it in. You may not be able to answer every question, such as "amount of medical expenses" if you haven't had any yet, just do the best you can and send it in immediately. Then, get the medical treatment you need. As long as the doctor signs that the treatment is medically necessary and related to the accident, you are covered. You can only recover financially from an injury if you have what is considered a "serious injury" as that term is defined by law. This includes death, miscarriage, fractures, a total disability that lasts 90 days or a permanent partial disability. The injury must be confirmed by objective medical proof such as an x-ray, MRI, CT scan or nerve conduction study.

First, anyone in a collision should go see a qualified medical professional and get checked out right away, and should follow all competent advice within reason. Second, any investigating authority (police) should have investigated the collision. If not, a Washington State Collision report, available on the State Patrol's website, should be completed and filed. Third, an experienced auto collision attorney should be consulted.
