QUESTION

What should I do after being sued for subrogation?

Asked on Nov 26th, 2013 on Automobile Accidents - California
More details to this question:
I got into a car accident about a year ago, I was unknowingly uninsured and sent to collections. I am a full time student and do not have any money to make any sort of payments. My parents recently agreed to help me make installment payments until I finish with school. The person in the collection agency told me it is too late and all that there is left to do is to lawyer up. I would pay, but do not have a job or any assets to my name. My parents are willing to pay for a lawyer. I just do not know how to proceed from here. I live in California

By getting a lawyer, you can drag the case out for a while, but eventually they will probably get a judgment against you. A judgment is just a piece of paper. They can chase you, but they can't get blood out of a stone.

Ask to speak to the manager at the collection agency to try to work out a deal. point out to them that if they are not willing to accept installment payments then they will get nothing for several years and if it is a very large sum of money you might file for bankruptcy to avoid the debt entirely. Normally insurance companies handle their own subrogation debt collection. There is no advantage in hiring an attorney as you owe the debt.
