You have a workers compensation case. It is either a new injury, or it is an aggravation of the preexisting condition. Since it happened on the job, it is a workers compensation matter and should be handled in that forum.

If you have already settled you workers comp claim, there is nothing you can do. If you file a claim within two years of the accident, but have not yet settled it, you could pursue the claim for your damages.

If you continue to have troubles it is a continuation of the previous workers compensation claim which most probably paid for your surgery, and the one coming up. As long as you have not settled the case is open. If you have questions see a workers compensation attorney.

I assume you settled your case long ago. Depending on how you settled it you may be able to reopen the case based on a change of condition. Why don't you see a worker comp lawyer in your town to be sure what applies.
