QUESTION

What should I do next after acquiring a lawyer?

Asked on Jun 08th, 2013 on Personal Injury - Florida
More details to this question:
I was hurt at work on May 20, 2012. I was on a leased lot at 4 a.m. in the dark and fell in a hole and broke my foot. I was off work for almost 6 months requiring surgery. Now a year later it is re-broken in the same spot. I am being told to get a lawyer. Since this happened the company I worked or has left me go and the company I work for now can only hold my job for 12 weeks under Family and Medical Leave Act.

If you hired a competent lawyer, then you ask the lawyer what he/she wants you to do to assist in the handling of the claim. Follow the instructions.

It sounds like you need to contact a workers compensation lawyer right away. He or she will be able to advise you what to do.

Family medical leave is unpaid. You should be able to receive temporary disability benefits either from the insurance company or from state disability benefits and your employer can't terminate your employment.

Rely on your lawyers review. The fact s did not make a lot of sense and don't really explain why you were hurt a second time and what this has to do with the first injury try again

You should retain a qualified personal injury lawyer. Our office handles cases like this all the time. The owner of the property may be responsible for your initial fracture and if the second fracture is related to the original incident, the owner of the property may be responsible for that also. The issue of whether or not the owner of the lot would be responsible for your injury depend on many numerous issues. Because you were working at the time you were injured, the New York Labor Law and the applicable regulations may be helpful to your case. With respect to lost wages and possible disability, I would also suggest that you retain a qualified workers' compensation lawyer as you may be entitled to benefits for medical expenses and lost wages.

Listen to him or her and do what they say. If you have questions, ask them. I am curious about the hole and whose responsibility it was to make the premises safe. You may have what lawyers call a "third party claim". It also sounds like you actually have 2 comp claims. Consult an experienced worker's comp lawyer who is also familiar with accident law.
