If your husband's insurance rightfully denied coverage as to the claim of the other driver/vehicle, then your only choice is to sue your husband's brother.  Since your husband owned the vehicle and had the insurance on the vehicle, your husband had a duty to timely report the claim to his insurance company and to make sure his brother timely cooperated with his insurance company when investigating the claim of the other driver/vehicle.  I suggest that you consider hiring a lawyer in your area who deals with insurance coverage issues and/or auto accidents.  You also might want to contact the Maryland Insurance Administration which regulates insurance companies in MD to determine if your husband's insurance company rightfully denied the claim of the other driver/vehicle.  Good luck with this matter.
