What will be my actions to retrieve the funds?

More details to this question:
Well she was in an accident at 2. She was awarded a settlement to be paid at age 18. Well 18th birthday is in a couple weeks. Will she be contacted or is there a court proceeding that we will have to initiate to start the process.

First, send a copy of the settlement agreement and order to the defendant or insurance company that will pay the amount. Hopefully they will issue the check to your daughter. If not, there is a way to petition the court to approve and direct the payment.

If you have a lawyer ask his help. If you don't go talk to the clerk of superior court in the court where the money is held.

If the insurance company has your correct address, they will contact you and start the process without any expense on your part. If you do not hear from them within a week or so of the birthday, contact them. You will need to give the claim number.

Contact the attorney who represented you and/or the bank who handled the account, the bank will have instructions to pay the sum over to your daughter upon proof that she is 18.

If she was represented by counsel, she should contact her counsel. If not, she should read the Court order granting the award to determine the insurance company and contact it.

Who was the insurance company with whom you settled? Contact them regarding the settlement which is probably in the form of an annuity.

IT all depends on who is holding the funds. Most likely, she will be contacted. However, if a law firm represented her, it would probably be appropriate to contact the firm and ask them. Most minor settlements must be approved by the court. You could visit or contact the court that approved the settlement and for a copy of the order approving the settlement, and it might have information on who is holding the money.

The answer should be in the settlement paperwork. If you don't have it, call the lawyer that handled the case for you. If you didn't have one, call the insurance company adjuster you dealt with. Good luck.

Contact the insurance company that will be paying the money to be sure they still have your correct address. You can talk with them about the mechanics of getting the check to your daughter after she turns 18.
