when to change lawyers

More details to this question:
I have a traumatic brain injury from a car accident. I am on disability as a result and have been out of work for almost 2years. My neurologist and my opto-neurologist confirm my brain injury. My lawyer have consistently forgotten details to my case and today told me we would not win my case because I have no evidence to my claims but could not recall crucial details to the case until I brought them up. Should I seek out a new lawyer?

You have the right to seek a new lawyer at anytime.  Keep in mind that if the collision occurred in VA, you 2 years from the date of the accident to either settle your claim or file a lawsuit to protect your rights.  If you seek out a new attorney, make sure that any new potential lawyer has experience handling traumatic brain injury claims due to car accidents.
