My 70 year old mother in law had just dropped of my daughter at her Catholic elementary school in NYC. While walking back to the car, she tripped over someone's leashed dog in a reasonably crowded schoolyard/parking lot. She hit her head, needed stitches across her nose, her entire face was swollen and bruised for 2 weeks and she reaggravated an existing knee injury. The person with the dog left the scene and my mother in law was taken to the hospital after being helped by some good Samaritans. Is anyone liable? The school? The dog owner? If so, would it simply be for medical bills, or could she be awarded something for pain and suffering?
