I am building a home and during the process, I had to get a permit from the State Of Ohio ODOT for a driveway to be put in. During this process, the state denied my permit due to my culvert I was planning on putting in. They required me to purchase concrete precast culverts which are roughly 15k. I thought this was highly unnecessary but rather argue, I went ahead and purchased them. They did allow me to put my original culvert in temporally while the precast ones are being manufactured. The semi truck delivering block for my basement could not make it up my newly constructed driveway and had to be pulled out by a towing company. In the process of being pulled out, the side of the road was damaged. I was told by ODOT that I needed to pay for damages to the road that occurred while the towing company was pulling the truck out. I recently received a letter from ODOT stating this. ODOT attorney sent me a quote stating 10k to repair the damages. Why am I responsible?
In order to determine where any potential liability lies a full case review is going to be necessary. Someone who specializes in construction cases is probably going to be your best bet.
