Do I need to hire an attorney?

More details to this question:
At a restaurant and a waitress spilled her tray on me with 2 glasses of ice water and a full picture if ice water. I was soaked my food got soaked and my cell phone. I cleaned off paid the bill still left a tip and left. Went back in and told the manager he offered to pay my deductible on my phone their insurance company contacted me and said they can pay my deductible or buy me a new phone. So I made a claim on my phone and was told the deductible is $229 and I would receive a refurbished phone. My phone is in immaculate condition just paid it off now has water damage. I told the insurance company I wanted a new phone and now she is arguing about that. Should I just take the deductible money or can I do more

In short, the restaurant would likely be required to pay for the damages they caused.  That number would be the fair market value of the phone based on the age, condition, etc. that it was in when it was broken, assuming it could not otherwise be repaired.
