Can a person be held liable for an expired contract?

More details to this question:
I signed no month to month contract with my landlord but the original one year lease says any roll over will go month to month. If I stay in my place must I rent month to month, or can I rent week to week?

The law says the same thing that your original lease agreement says. Once your lease expires, you become a month-to-month tenant subject all other terms of the lease.

If you contract states month-to-month, so it is. If you can get an agreement with the landlord to make it week to week, that is a new agreement and supersedes the prior one. Did not be foolish and if there is a modification get it in writing.

Generally Michigan law states that holdover leases are for the period of how you were paying under the initial lease. So if you were paying your annual rent under the written lease in monthly installments its a month to month lease if you were paying weekly its a week to week lease.

You are on a month to month basis unless your landlord will agree to week to week.
